Protected Olympic Marks

Reference to any protected International Olympic Committee or United States Olympic Committee Trademarks, Logos, or Copyrights on the Personal GOLD website, downloadable software, or non-downloadable software fall within permissible usage in the following manner:

1. Historical documentation and description of Personal GOLD helping athletes win Olympic medals at the 2012 London Olympics and referencing their personal property (Olympic medals, Olympic medal-winning).

2. Using the term 'Olympian or Olympic athlete' to describe founders or advisors that were members of Olympic teams or alternates on Olympic teams. 

Neither of these references constitute or imply endorsement, sponsorship or recommendation thereof of Personal GOLD by the International Olympic Committee, and all references outside the above permissible usage are protected by the International Olympic Committee.

Protected Olympic marks appearing or referenced in the feature documentary film 'Personal Gold, An Underdog Story' fall under 'Fair Use Policy' detailed in the opinion letter by Donaldson Callif, 400 South Beverly Drive, Ste 400, Beverly Hills, CA. 90212.

Patents

A patent is a set of exclusive rights granted by a sovereign state or intergovernmental organization to an inventor or assignee for a limited period of time in exchange for detailed public disclosure of an invention. An invention is a solution to a specific technological problem and is a product or a process.

The core functionality and utility of the Personal GOLD software has obtained patent-pending status from the United States Patent and Trademark Office which spans from March 2018 to current. 

Trademarks

A trademark can be a word, phrase, symbol, or design that distinguishes the source of the goods or services. Also, as trade dress, it can be the appearance of a product or its packaging, including size, shape, color, texture, graphics, and appearance (e.g, retail store or website).

When using the marks in publications that will be distributed only in the United States, include the appropriate ™, ℠, or ® symbol on first use. For publications that will be distributed outside the United States, do not include trademark symbols. Instead use the appropriate trademark attribution notice, for example: Mac and macOS are trademarks of Apple Inc., registered in the U.S. and other countries.

Other Third Party Marks

All third party trademarks referenced by Personal GOLD website and software whether in logo form, name form or product form, or otherwise remain the property of their respective holders, and are used by us only to refer to the contextual use of the development of software and other technology and products utilizing health and fitness advice and supporting third party solutions. Our use of these trademarks in no way indicates any relationship between Personal GOLD, Inc. and the holders of these trademarks. Rather, any usage of third party trademarks by us is to refer to such products is considered nominative fair use under trademark law.
